Written Submissions Sought on Draft Gas Bill

Brought to you by SA Legal Academy: The National Assembly’s Portfolio Committee on Electricity and Energy has issued a public notice requesting written submissions on the draft Gas Bill, which was tabled in Parliament in March 2026.

The proposed legislation, once enacted, will repeal and replace the Gas Act, No. 48 of 2001. According to the memorandum on the objects of the Bill, the new regulatory framework aims to address regulatory loopholes, omissions, and enforcement challenges experienced under the prevailing Act.

A key focus of the draft Bill is the integration of new technologies and alternative gas sources into the national regulatory framework. The Bill introduces specific provisions for:

  • Liquefied natural gas (LNG);
  • Low-carbon gases; and
  • Renewable gases.

Stakeholders and interested parties have until 7 August 2026 to submit written representations on the Bill to the Portfolio Committee ahead of the first round of public hearings.

  • For yourself: No direct individual compliance obligations; however, legal and regulatory advisors in the energy sector must familiarise themselves with the transition from the Gas Act of 2001 to the new proposed framework.
