Brought to you by SA Legal Academy: The Minister of Finance has approved the 2026 annual policy benefit escalations for health and accident insurance policies governed by demarcation regulations.

In terms of the demarcation regulations promulgated under the Long-term Insurance Act, No. 52 of 1998, and the Short-term Insurance Act, No. 53 of 1998, the Minister of Finance has approved the revised statutory benefit escalation thresholds for 2026.

The demarcation regulations, operational since 1 April 2017, define the regulatory boundary between insurance products and medical scheme business under the Medical Schemes Act, No. 131 of 1998. Certain health and accident insurance policies—including gap cover policies and hospital cash plans—are exempt from the Medical Schemes Act provided they adhere to prescribed benefit limits, which are adjusted annually by National Treasury to align with statutory escalation formulas.

Insurers and regulated intermediaries must note that the escalated thresholds apply directly to the design, marketing, and claims processing of all compliant health insurance contracts entering into force or renewing for the 2026 policy period.
