Draft National Building Regulations Amendment Bill Published for Comment

Brought to you by SA Legal Academy: The Department of Trade, Industry & Competition (DTIC) has published the draft National Building Regulations and Building Standards Amendment Bill, inviting written representations and public comment on proposed statutory revisions to the building regulatory environment.

The draft Bill proposes substantive amendments to the National Building Regulations and Building Standards Act, No. 103 of 1977. According to notices issued by the DTIC, comments on the draft Bill are requested by 2 November 2026, superseding an earlier deadline of 1 September 2026 that accompanied a Government Gazette notice gazetted on 3 July.

The proposed legislative overhaul targets key mechanisms governing building approvals, enforcement, and standards compliance across local authorities. Among the core statutory objectives set out in the draft Bill’s long title are:

• Updating regulatory terminology, technical definitions, and national building standard designations to align with contemporary construction and safety requirements;
• Streamlining and strengthening municipal administrative procedures for building plan submissions, evaluations, approvals, and occupancy certifications;
• Enhancing the statutory enforcement powers and inspection mandates of local authority building control officers;
• Revising penalty provisions and dispute resolution frameworks for contraventions of approved plans and statutory regulations.
