Kruger National Park Land Claim Beneficiation Agreement Signed

Brought to you by SAnews: The Department of Forestry, Fisheries and the Environment (DFFE) and South African National Parks (SANParks) have finalised and signed the Beneficiation Scheme Framework Agreement with historically land-dispossessed claimant communities surrounding the Kruger National Park.

The agreement marks the conclusion of a formal negotiation process that commenced in 2012, following a 2008 Cabinet decision. That decision designated the Kruger National Park as a strategic national asset, establishing that while the park must remain protected and free from residential occupation, claimant communities who lodged claims in the early 2000s under the Restitution of Land Rights Act, No. 22 of 1994, are entitled to equitable redress and heritage recognition.

Under the newly signed Beneficiation Scheme, SANParks will facilitate structured access to both commercial and non-commercial opportunities for qualifying communities. This framework is designed to integrate local communities into the park’s economy as active partners rather than passive spectators.

Key Elements of the Beneficiation Scheme

The agreement outlines specific channels through which claimant communities will derive economic and heritage benefits, including:

  • Commercial Concessions & Shareholding: Structured equity and participation in commercial operations within the park.
  • Enterprise and Supplier Development: Preferential procurement and business development support for community-owned enterprises.
  • Revenue Sharing: Allocation of a designated percentage of net revenue generated by park operations.
  • Human Capital Investment: Establishment of a dedicated bursary fund and structured skills transfer programmes.
  • Heritage & Access Rights: Non-commercial benefits, including naming rights for specific sites and formalised access rights for cultural or heritage purposes.

What this means for you, your business, or your clients

  • For yourself: No direct individual compliance obligations; professional awareness is recommended for practitioners advising on land restitution and community trust governance.
  • For your business: Legal and financial advisory firms operating in the tourism, conservation, or community development sectors in Mpumalanga and Limpopo should update their advisory frameworks to align with the new commercial structures permitted under this agreement.
  • For your clients: Claimant community trusts and commercial tourism operators seeking partnerships or concessions within the Kruger National Park must review the Beneficiation Scheme to identify qualifying shareholding, joint venture, and enterprise development opportunities.
