Explosives Act, 1956 (Act No. 26 of 1956)

31. Application of this Act

 

 

Save as is otherwise provided in section 8A, nothing in this Act contained shall apply--

a) to the importation, storage, use, manufacture or transport of any explosive by the South African Defence Force or any police force constituted under any law or by the defence force of any country which the Minister, after consultation with the Minister of Defence, by notice in the Gazette exempts from the provisions of this Act relating to such importation, storage, use, manufacture or transport: Provided that the Minister may in the same manner cancel or suspend any exemption thus granted;
b) to any ammunition, if a licence to possess it or to deal therein is regulated by any other law;
c) to the transfer, transport, use, storage and distribution of explosives in so far as these activities are governed by any regulation made under paragraph (f) of sub-section (1) of section 12 on the Mines and Works Act, 1956 (Act No. 27 of 1956);
d) to the possession or conveyance of any explosive taken as a sample for the purpose of this Act by an inspector or other duly authorized person, provided the quantity is not more than is reasonably necessary for the performance of his duty and every such sample is kept and conveyed with all due precaution.
