Chapter 2 : Appointment And Powers Of Inspectors And Disposal Of Explosives

7. Forfeiture

 

 

1) If any explosives seized in terms of section 6 are forfeited to the State in terms of section 35 of the Criminal Procedure Act, 1977 (Act No. 51 of 1977), the Chief Inspector may instruct that the explosives must be –
a) kept for research and developmental purposes;
b) sold to cover expenses incurred in the storing of the explosives pending the finalisation of the criminal proceedings; or
c) destroyed in accordance with section 8.
