| 1) | Should the Inspecting Judge or an Assistant be a judge retired from active service in terms of section 3(1)(a) of the Judges’ Remuneration and Conditions of Employment Act, 1989 (Act No. 88 of 1989), any period of service as Inspecting Judge or an Assistant shall be reckoned as service performed in terms of section 7(1) of the said Act and the provisions of subsections (3) and (6) thereof shall apply to such appointment. |
| 2) | Should the appointee be a judge retired from active service in terms of section 3(1)(b), (c) or (d) of the said Act, the remuneration payable to such appointee shall be determined by the Minister of Justice or agreed with the prospective appointee. |
