I, Dr MJ Phaahla, Minister of Health, hereby, after consultation with the Advisory Committee, in terms of section 105A of the Occupational Diseases in Mines and Works Act, 1973 (Act No. 78 of 1973) ("the Act"), amend the following amounts appearing in sections 80(2) and 80(3) of the Act so as to increase benefits, with effect from 1 April 2023, as follows:
| (a) | the amount representing the person's earnings, specified in section 80(2) of the Act increases from R4 555 (Four thousand five hundred and fifty five rand) to R4 870 (Four thousand eight hundred and seventy rand) |
| (b) | the amount specified in section 80(3) of the Act increases from to R50 793 (Fifty thousand seven hundred and ninety three rand) to R54 298 (Fifty four thousand two hundred and ninety eight rand) |
| (c) | 1 April 2023, being the date on or after which: |
| (i) | an examination to determine the presence, nature and degree of a compensable disease was conducted; or |
| (ii) | the first of such examinations, in a series of examinations, commenced; or |
| (iii) | a post-mortem examination was partially or wholly conducted on the person who allegedly died of a compensable disease. |
