Brought to you by SA Legal Academy: The Judicial Service Commission (JSC) has published a call for public comments on proposals to revise two key procedural frameworks governing judicial appointments and misconduct matters.

In terms of section 178 of the Constitution of the Republic of South Africa, 1996, read with the Judicial Service Commission Act, No. 9 of 1994, the Commission operates to advise the national government on judicial appointments and investigate complaints lodged against judicial officers. The proposed revisions are intended to establish a clear and transparent framework governing JSC processes.

The procedural review specifically covers the following operational areas:

  • Procedures governing the nomination, screening, and interview selection criteria for candidates seeking judicial appointment;
  • Mechanisms for handling breach-related complaints and disciplinary processes under the Code of Judicial Conduct; and
  • Rules and criteria regulating the transfer of judges from one Division of the High Court to another.

The deadline for public submissions and written comments is 17 September 2026.
