Brought to you by SA Legal Academy: The Department of Agriculture, Land Reform and Rural Development has published an explanatory summary of the upcoming Electronic Deeds Registration & Recordal Systems Amendment Bill ahead of its formal introduction to Parliament.

In terms of executive legislative procedures, the published explanatory summary follows Cabinet approval of the proposed legislation at its meeting on 1 July 2026. The Bill is technical in nature and aims to modernise the legislative framework governing deeds registration and recordal systems across South Africa.

To establish a fully integrated digital registration framework, the Bill proposes key statutory amendments across three principal enactments:

  • Deeds Registries Act, No. 47 of 1937: Updating administrative and operational provisions to enable electronic preparation, lodging, and registration of deeds and land registry documentation.
  • Sectional Titles Act, No. 95 of 1986: Harmonising sectional title register requirements, sectional plan filings, and unit transfers with automated recordal systems.
  • Electronic Deeds Registration System Act, No. 19 of 2019: Enhancing functional rules, data integrity standards, and recordal protocols governing the electronic deeds registry.
