59. Licence transfers

 

1) This section does not apply to employment licences.

 

2) A person who acquires the business to which a licence relates, or acquires a controlling interest in a licensee, must apply to the relevant provincial licensing authority or the board for a transfer of that licence or approval of that acquisition, as the case may be.

 

3) A provincial licensing authority or the board must not grant a transfer of a licence or approval of that acquisition, as the case may be if, after conducting the prescribed investigations, the licensing authority has reason to believe that, as a result of that transfer or acquisition, a person who is disqualified in terms of section 50(2) or relevant provincial law would directly or indirectly hold any of the total financial interest in the licensee or the business to which the licence relates.
