In the case of a measuring instrument falling within the meaning of regulation 137, but excluding instruments used by persons complying with the requirements of SANS 1841 and permitted to apply the "e" mark—
| (a) |
both the supplier and the user must satisfy themselves that such instrument is suitable for the purpose for which it is used or intended to be used and is capable of correct determination of quantity; |
| (b) |
the owner or the user must maintain and operate such measuring instrument at all times in such a manner that it determines and discharges the correct quantity of goods to be sold in prepackaged form subject to the provisions of SANS 458; |
| (c) |
the user of such measuring instrument must take such steps as will enable him or her to detect any incorrect quantities of goods which may have been determined by the instrument; |
| (d) |
the user of such measuring instrument must keep a suitable verified measuring instrument conforming to the requirements of SANS 458 for the purpose of checking the quantity of goods or articles which may have been determined by the instrument; and |
| (e) |
the records of the checks contemplated in paragraph (d) must be kept for inspection by an authorised officer to prove that the applicable requirements of SANS 458 were complied with at the time of packing. |
