Usury Act, 1968 (Act No. 73 of 1968)

Prohibition on the Use of Personal Information as Security or Collection Arrangements

I, Alexander Erwin, Minister of Trade and Industry, do hereby exercise the powers vested in me under section 16 of the Usury Act, 1968, as set out in the Schedule.

 

Schedule

 

 

1) In this schedule any word to which a meaning has been ascribed in the Usury Act, 1968, shall have the meaning ascribed to it in the Act, and

 

"personal information" means information such as pin codes and bank cards.

 

 

2) No person shall make use of personal information as
i) security for any money lending transaction; or
ii) collection arrangement.

 

 

3) Any person acting in contravention of this schedule shall be guilty of an offence and liable on conviction to the penalties prescribed in section 17 of the Usury Act, 1968.
