Purchase

(1)	In the assessment of any penalty in terms of section 115(a), the court must take into account any award previously made under section 77 which arises from the same cause.

(2)	In the assessment of any award under section 77, the court must take into account any penalty which arises from the same cause and previously imposed in terms of section 115(a).
