Regulations Relating to Summons and Oath

2. Summons

 

(1) A summons, as contemplated in section 28(6)(a) and (7) of the Act, must be in a form that substantially corresponds to Form 1 of the Annexure to these regulations.

 

(2) The summons, together with a copy thereof, shall be delivered to the sheriff to deal therewith in terms of subregulations (3) to (5).

 

(3) The summons shall be served by the sheriff, by delivering a copy thereof to the person mentioned therein or, if he or she cannot be found, by delivering it at his or her place of residence, employment or business to a person who appears to be over the age of sixteen years old and who appears to reside or to be employed there.

 

(4) The sheriff shall, upon the request of the person mentioned in the summons, exhibit to him or her the original summons.

 

(5) The sheriff shall, on a form that substantially corresponds to Form 2 of the Annexure to these regulations, endorse the manner in which the copy of the summons was served, and attach the form to the summons and return it to the Investigating Director.
