| 1. | By virtue of the powers vested in me in terms of Section 1 of the Competition Act, 1998 (Act no. 89 of 1998), I Ebrahim Patel, Minister of Trade and Industry, hereby determine that— |
| (a) | the definitions of "medium-sized business" and "small business" provided for in section 1 of the Competition Act, 1998, shall have the following meanings, respectively: |
| (i) | "medium-sized business" |
means a separate and distinct business entity, together with its branches or subsidiaries, if any, including cooperative enterprises, managed by one owner or more predominantly carried on in any sector or subsector of the economy mentioned in column 1 of the Schedule hereto; and satisfying the applicable criteria for a medium-sized business as mentioned in columns 3 and 4 of the Schedule to this Notice; and
| (ii) | "small business" |
means a separate and distinct business entity, together with its branches or subsidiaries, if any, including cooperative enterprises, managed by one owner or more predominantly carried on in any sector or subsector of the economy mentioned in column 1 of the Schedule hereto; and satisfying the applicable criteria for a small or micro business as mentioned in columns 3 and 4 of the Schedule of this Notice; and
| (b) | this Notice shall be of force and effect as from the date of publication of the Presidential Proclamation providing for the commencement of certain sections of the Competition Amendment Act, 2018 (Act No. 18 of 2018), dated 06 July 2019. |
