Brought to you by SA Legal Academy: The Department of Justice & Constitutional Development has published draft amendments to the rules regulating Small Claims Courts under the Small Claims Courts Act, No. 61 of 1984, with public comments invited by 4 December 2026.

The proposed amendments, formulated in conjunction with the Rules Board for Courts of Law in terms of the Rules Board for Courts of Law Act, No. 107 of 1985, focus specifically on the institutional framework governing Small Claims Court advisory boards.

The draft rules establish explicit regulatory provisions governing:

  • The composition and appointment processes for advisory board members;
  • The formal statutory powers and operational functions assigned to advisory boards;
  • General internal administration and operational management; and
  • Mandatory reporting obligations to departmental structures.

An explanatory note issued by the Rules Board for Courts of Law highlights revisions made following earlier internal consultations. The revised draft adopts an approach specifically designed to avoid the proliferation of excessive formal administrative structures across magisterial districts, sub-districts, and detached court facilities.

Submissions on the draft rules must be submitted to the Department of Justice & Constitutional Development on or before 4 December 2026.

What this means for you, your business, or your clients

  • For yourself: Practitioners serving as Small Claims Court commissioners or participating in local advisory structures must review the proposed governance and reporting duties to determine their administrative liabilities.
  • For your business: Law firms and legal clinics interacting with district court registries should assess how the consolidated advisory structure affects local court functioning and stakeholder coordination.
  • For your clients: Small business clients and individual litigants relying on small claims mechanisms will face a more standardized administrative oversight model across district and detached court venues.
