National Opt-Out Registry: Monthly Database Cleansing Required for Direct Marketers

Brought to you by SAnews: The Department of Trade, Industry and Competition (DTIC), together with the National Consumer Commission and the Information Regulator, has launched the operational National Opt-Out Registry system to regulate direct marketing communications under South African law.

In terms of section 11 of the Consumer Protection Act, No. 68 of 2008 (CPA), read alongside the direct marketing provisions of the Protection of Personal Information Act, No. 4 of 2013 (POPIA), consumers have the right to restrict unsolicited direct marketing. The newly operationalised Registry provides a centralised mechanism for consumers to pre-emptively register their refusal to receive direct marketing communications.

Under the regulatory framework, direct marketers face explicit compliance obligations prior to contacting prospects:

  • Direct marketers must cleanse their marketing databases against the National Opt-Out Registry on a monthly basis prior to deploying any direct marketing campaigns.
  • Consumers registered on the Registry are shielded from receiving unsolicited electronic or telephonic marketing communications without prior opt-in consent.
  • The registry framework is jointly monitored by the National Consumer Commission and the Information Regulator to enforce both consumer protection and data privacy standards.

  • For yourself: You can register your personal contact details on the National Opt-Out Registry to pre-emptively prohibit direct marketers from sending unsolicited communications.
  • For your business: If your practice engages in direct client acquisition or marketing, you must implement a formal monthly process to scrub your contact databases against the official registry before transmitting campaigns, mitigating exposure to regulatory penalties under the CPA and POPIA.
  • For your clients: Advise corporate and commercial clients operating call centres, digital marketing funnels, or direct-sales models to update standard operating procedures immediately to incorporate mandatory monthly Registry reconciliation and retain audit logs of compliance.
