Department of Communications to Review ICASA Mandate on Online Betting Safeguards

Brought to you by SAnews: The Minister of Communications and Digital Technologies has announced planned formal engagements with the Independent Communications Authority of South Africa (ICASA) to review regulatory safeguards governing electronic communications networks and services that facilitate access to online gambling and betting products.

In terms of the regulatory framework established under the Electronic Communications Act, No. 36 of 2005 and the Independent Communications Authority of South Africa Act, No. 13 of 2000, the Department seeks to evaluate what interventions fall within ICASA’s statutory mandate to protect consumers, specifically regarding sports betting distributed across digital infrastructure.

Scope of Regulatory Review

The engagement focuses on evaluating operator compliance and examining the intersection between network distribution, broadcast licensing, and the National Gambling Act, No. 7 of 2004. Key regulatory priorities identified for assessment include:

  • The enforceability of consumer protection safeguards where electronic communications network service (ECNS) and electronic communications service (ECS) licensees facilitate access to betting platforms;
  • Compliance by commercial broadcasters and digital distribution channels with advertising restrictions, geolocation targeting, and responsible gambling disclaimers; and
  • The mitigation of financial and socio-economic risks to vulnerable consumers arising from the proliferation of mobile-enabled betting services and algorithm-driven targeted advertising.

The Department indicated that while digital commercialisation, geolocation-based marketing, and automated broadcast technologies generate significant commercial revenues for sports federations and broadcasters, regulatory frameworks must keep pace with consumer protection obligations across all licensed electronic platforms.

What this means for you, your business, or your clients

  • For yourself: No immediate individual compliance requirements; watch for public notice-and-comment procedures should ICASA initiate formal inquiries into online gambling distribution.
  • For your business: Broadcasters, media houses, and digital platforms carrying sports betting advertising should audit current flighting schedules and targeted ad mechanics against existing ICASA advertising code regulations and the Code of Advertising Practice.
  • For your clients: Online betting operators, platform aggregators, and sports rights holders must prepare for increased regulatory scrutiny regarding distribution channels, age-gating mechanisms, and potential network-level compliance obligations.
