CIPC Launches Real-Time Beneficial Ownership Module for Law Enforcement

Brought to you by SAnews: The Companies and Intellectual Property Commission (CIPC) has launched a dedicated Beneficial Ownership Disclosure Module granting accredited law enforcement agencies unrestricted, real-time access to corporate ownership data and verification records.

Under the beneficial ownership transparency regime enacted through the Companies Act, No. 71 of 2008 (as amended by the General Laws (Anti-Money Laundering and Combating Terrorism Financing) Amendment Act, No. 22 of 2022), the platform automates data-sharing among regulatory bodies to identify multi-layered shell entities and combat illicit financial flows.

The module enables investigators from the South African Revenue Service (SARS), the Financial Intelligence Centre (FIC), the South African Police Service (SAPS), and the National Prosecuting Authority (NPA) to:

  • Access registered beneficial ownership data and download original supporting verification documents 24 hours a day;
  • Map director networks across the entire CIPC database, linking individuals to all active and inactive corporate entities; and
  • Trace layered equity ownership and control structures across domestic and foreign holdings without administrative delays.

According to the Department of Trade, Industry and Competition and the CIPC, operational metrics since the beneficial ownership register opened on 1 April 2023 include:

  • More than 3,000,000 beneficial ownership filings received;
  • Over 618 formal investigations concluded into entity non-compliance and abuse; and
  • More than 350 compliance notices issued to non-compliant entities and companies that submitted fraudulent or inaccurate supporting records.

The system upgrade forms part of South Africa’s commitments to exit the Financial Action Task Force (FATF) grey list, with the CIPC confirming that the next mutual evaluation effectiveness report is due to the FATF on 19 October 2026.
