Public Input Sought on Draft Regulation of Trusts Bill and Mining Laws Amendment Bill

Brought to you by SA Legal Academy: The Department of Justice & Constitutional Development has published a gazette notice inviting written public input on two legislative measures: the draft Regulation of Trusts Bill and the draft General (Mining) Laws Amendment Bill.

Approved by Cabinet on 29 July 2026 for public consultation, the draft Regulation of Trusts Bill intends to modernise trust administration in South Africa. Upon enactment, the Bill will repeal and replace the Trust Property Control Act, No. 57 of 1988.

Cabinet simultaneously approved the draft General (Mining) Laws Amendment Bill on 29 July 2026. This Bill seeks to strengthen the legislative framework in order to curb illicit mining and related activities through targeted amendments that explicitly criminalise illicit mining and associated offences.

Public comments on both draft Bills must be submitted to the Department of Justice & Constitutional Development by no later than 11 September 2026.
