Independent Municipal Demarcation Authority Bill

The Independent Municipal Demarcation Authority Bill, originally tabled in Parliament in June 2022, creates a revised statutory framework for municipal demarcation and ward determination. The final ‘D’ version reflects amendments proposed by the National Council of Provinces (NCOP) and subsequently adopted by the National Assembly.

Once enacted and operationalised, the legislation will establish the Independent Municipal Demarcation Authority to oversee boundary demarcations. Key provisions include:

  • Service delivery and governance: Alignment of municipal boundaries to support local economic development, municipal financial viability, and equitable service delivery.
  • Governance and board structure: Procedures for appointing members to the Independent Municipal Demarcation Authority board and its technical committees.
  • Public consultation: Mandatory public engagement frameworks prior to finalising municipal boundary or ward changes.

One-Stop Border Post Bill

The One-Stop Border Post Bill, tabled in September 2024, establishes the legislative framework to implement one-stop border posts between South Africa and neighbouring states. The ‘B’ version awaiting presidential signature provides for shared border infrastructure and administrative cooperation.

Key regulatory features include:

  • Common control zones: Authorisation for South African border control authorities and foreign counterparts to exercise joint jurisdiction in designated common control zones.
  • Equipment transfer protocols: Provisions governing the transfer of equipment within a common control zone where necessary for officials to perform duties, subject to formal declarations and inventory registers.
  • Streamlined trade and movement: Statutory mechanisms designed to reduce transit times and streamline customs and immigration procedures for cross-border commerce.
