Madlanga Commission Submits Second Interim Report on Criminal Justice System Corruption
Brought to you by SAnews: President Cyril Ramaphosa has noted the recommendations and referrals contained in the Second Interim Report of the Judicial Commission of Inquiry into Criminality, Political Interference and Corruption in the Criminal Justice System.
In terms of clauses 10.4 and 12 of its Terms of Reference, the Commission’s report—submitted on 29 May 2026 by Acting Deputy Chief Justice Mbuyiseli Madlanga—recommends immediate disciplinary proceedings and criminal investigations against specified individuals, following its first interim report submitted on 17 December 2025. Clause 10.4 empowers the Commission to refer matters for immediate criminal investigation and urgent decisions on prosecution, while clause 12 authorises referrals for prosecution, further investigation, or separate inquiries to appropriate law enforcement agencies or regulators.
The report confirms earlier prima facie recommendations concerning the South African Police Service (SAPS) after hearing evidence from implicated parties, and sets out new directives arising from testimony led since early 2026.
Key Recommendations and Regulatory Directives
The Commission has recommended the following enforcement actions:
- Disciplinary and Criminal Investigations: Immediate institution of disciplinary proceedings and criminal investigations against Lieutenant General Shadrack Sibiya, Witness G, Sergeant Fannie Nkosi, and Brown Mogotsi, with a view to prosecution if sufficient evidence exists.
- Intelligence Oversight Investigation: An immediate investigation by the Office of the Inspector General for Intelligence, or another authorised functionary, into alleged off-the-books operations within Crime Intelligence involving Mogotsi and Witness G.
- Integration into SAPS Task Team: All new referrals will be incorporated into the SAPS special investigations task team established following the first interim report to execute urgent investigations.
The Commission, established following claims made by Lieutenant-General Nhlanhla Mkhwanazi on 6 July 2025, is scheduled to submit its final report to the President on 16 November 2026.
