Brought to you by SA Legal Academy: The Department of Electricity & Energy has gazetted an electricity sector market transformation position paper and called for public comment by 20 September 2026.

Underpinned by the objectives of the National Development Plan (NDP) 2030, the position paper outlines government’s strategic roadmap for a transformed energy system. The policy framework seeks to manage South Africa’s ongoing ‘energy quadrilemma’ by balancing energy security, universal access, affordability, and environmental sustainability.

The position paper establishes the regulatory and operational baseline for introducing a competitive wholesale electricity market as the primary mechanism for restructuring the sector. Key focus areas include:

  • Establishing clear structural roles for generation, transmission, and distribution stakeholders;
  • Implementing mechanisms for decarbonisation and clean energy integration;
  • Addressing technical and financial performance constraints across municipal and national electricity distribution networks; and
  • Transitioning from a single-buyer model to an open-market, multi-market wholesale trading platform.

Submissions and representations on the position paper must reach the Department of Electricity & Energy on or before 20 September 2026.
