Draft Private Members’ Amendment Bills Proposed for Public Procurement Act 28 of 2024

In terms of parliamentary rules governing Private Members’ Bills, gazetted explanatory summaries serve as pre-tabling notifications to solicit stakeholder feedback prior to formal introduction in the National Assembly. The published proposals comprise two distinct legislative initiatives:

  • ActionSA Proposal (MP Alan Beesley): Focuses on the legal regime surrounding debarment under the Act. This proposal is intended to augment the Public Procurement Second Amendment Bill tabled in March 2026 by ActionSA MP Malebo Kobe, which remain pending before the relevant National Assembly committee and did not encompass debarment provisions.
  • Democratic Alliance Proposal (MP George Michalakis): Reintroduces proposed reform measures aligned with draft proposals previously gazetted by DA MP Mathew Cuthbert in December 2025.

Neither set of published proposals makes reference to other public procurement amending legislation currently before Parliament or previously released for public consultation.
