Small Claims Court Jurisdiction Limit Increased to R30 000
Brought to you by SAnews: The Department of Justice and Constitutional Development has announced an increase in the monetary jurisdiction threshold of Small Claims Courts from R20 000 to R30 000, effective 1 August 2026.
In terms of the framework established under the Small Claims Courts Act, No. 61 of 1984, the monetary limit for civil actions brought before Small Claims Courts across all 418 court areas in South Africa will be adjusted upward to R30 000. This represents the first adjustment to the monetary jurisdiction of these courts in seven years.
Small Claims Courts provide a simplified, accessible legal forum for minor civil disputes without requiring formal legal representation. Departmental data shows that 36 000 claims valued at R257 million were registered during the preceding financial year, with an additional 8 825 cases valued at R64 million registered in the first quarter of the current financial year.
Civil matters falling within the jurisdiction of the court include:
- Unpaid personal loans and debt recovery actions;
- Consumer disputes concerning defective goods or incomplete contractor services;
- Vehicle property damage claims arising from minor collisions or substandard repairs; and
- Claims relating to the delivery of movable property and credit agreement disputes.

- For yourself: You can institute personal civil claims and debt recovery actions up to R30 000 through the Small Claims Court from 1 August 2026 without paying legal representation fees.
- For your business: Sole proprietors and unincorporated traders can utilise the increased R30 000 limit to pursue minor commercial debts efficiently, though corporate entities remain excluded from instituting claims as plaintiffs under the Small Claims Courts Act, No. 61 of 1984.
- For your clients: Advise individual clients with unliquidated civil claims or debts between R20 000 and R30 000 to consider deferring action until 1 August 2026 to access the expedited Small Claims Court process instead of incurring Magistrates’ Court litigation costs.
