Brought to you by SA Legal Academy: In terms of the Rules Board for Courts of Law Act, No. 107 of 1985, the Rules Board has proposed amendments to the Rules Regulating the Conduct of the Proceedings of the Magistrates’ Courts of South Africa to consolidate overlapping reasons-in-writing obligations in civil appeals.

The proposed amendments target duplicate provisions within two sub-rules that govern the request for and delivery of written judgments and reasons. By consolidating these provisions, the Rules Board aims to eliminate procedural redundancies, clarify the duties of judicial officers, and streamline the civil appeals process for litigants.

Stakeholders, legal practitioners, and interested parties are invited to review the proposed changes and submit written representations. The deadline for the submission of comments to the Rules Board for Courts of Law is 31 August 2026.

  • Consolidation of sub-rules: Merging redundant provisions regarding reasons-in-writing obligations to simplify the pre-appeal process.
  • Procedural efficiency: Reducing administrative delays in the Magistrates’ Courts by establishing a single, clear timeline for requesting and delivering reasons.
  • Clarity for litigants: Ensuring legal practitioners have unambiguous guidelines on when and how to request written reasons to prosecute civil appeals.

What this means for you, your business, or your clients

  • For yourself: No direct individual obligations; impact is channelled through professional litigation practice and compliance with updated court rules.
  • For your business: Litigation departments and law firms must monitor the progress of these draft rules to update internal civil procedure templates and training materials ahead of the implementation date.
  • For your clients: Clients involved in civil litigation will benefit from reduced procedural delays and potentially lower costs associated with initiating civil appeals in the Magistrates’ Courts.
