Madlanga Commission Reporting Deadline Extended to November 2026
Brought to you by SAnews: President Cyril Ramaphosa has extended the reporting and evidence-gathering deadlines for the Commission of Inquiry into Criminality, Political Interference, and Corruption in the Criminal Justice System.
In terms of the powers vested in the President under the Constitution of the Republic of South Africa, 1996, the terms of reference for the inquiry—commonly referred to as the Madlanga Commission—have been amended to allow the body to conclude outstanding investigations. The Commission was originally established to investigate allegations of systemic corruption, political interference, and criminality within South Africa’s criminal justice structures, following disclosures made by KwaZulu-Natal Provincial Commissioner Lieutenant-General Nhlanhla Mkhwanazi on 6 July 2025.
The newly adjusted regulatory and reporting schedule is structured as follows:
- Evidence Submission Deadline: Friday, 2 October 2026, allowing the Commission to finalise hearings on topics opened during its proceedings.
- Final Reporting Deadline: Monday, 16 November 2026, shifting the previous deadline from the end of August 2026.
To date, the Commission has submitted two interim reports to the President. The extension is intended to prevent substantial portions of the Commission’s mandated work from remaining unfinished, ensuring all matters listed in its terms of reference are fully ventilated.
What this means for you, your business, or your clients
- For yourself: No direct individual compliance obligations; legal and compliance professionals should monitor the public hearings and upcoming evidence submissions for insights into systemic risks within criminal justice agencies.
- For your business: Risk and compliance officers must track the Commission’s findings to update internal anti-bribery, corruption, and politically exposed person (PEP) risk assessment frameworks.
- For your clients: Corporate clients, particularly those interacting with state law enforcement or public procurement oversight bodies, should prepare for heightened regulatory scrutiny as enforcement agencies act on the Commission’s interim and final recommendations.
