Launch of IDAC Oversight Judge Office Clarifies Statutory Mandate

Brought to you by SA Legal Academy: The Department of Justice and Constitutional Development has formally launched the Office of the Independent Directorate Against Corruption (IDAC) Oversight Judge, establishing a dedicated ombud mechanism under the National Prosecuting Authority Act, No. 32 of 1998.

In terms of section 22A(4) of the National Prosecuting Authority Act, No. 32 of 1998, the newly established office is mandated to investigate complaints concerning officials within the IDAC. The oversight mechanism officially launched on 10 July 2026, followed by an initial media briefing on 19 July 2026 by the head of the unit, retired Judge Takalani Raulinga.

The statutory mandate of the Oversight Judge focuses on addressing specific internal and operational grievances. The office is empowered to investigate:

  • Violations of rights occurring during IDAC operations;
  • Improper conduct by IDAC officials in the execution of their duties; and
  • Obstruction in the exercise of the powers, duties, and functions of officials within the directorate.

According to Judge Raulinga, the office will operate with strict judicial detachment, functioning within defined constitutional and legislative boundaries to complement existing law enforcement and oversight mechanisms.
