IDAC Oversight Office Operationalised Under NPA Amendment Act
Brought to you by SAnews: The Office of the Independent Directorate Against Corruption (IDAC) Oversight Judge has been operationalised, completing a key component of South Africa’s constitutional and anti-corruption architecture.
In terms of section 22A of the National Prosecuting Authority Amendment Act, No. 14 of 2024, the newly established office is headed by retired Judge Takalani Joseph Raulinga. The office is tasked with providing independent judicial oversight over the IDAC, ensuring that investigative and prosecutorial powers are exercised within the bounds of legality, accountability, and fairness.
Under section 7(4)(a) of the Act, the IDAC Oversight Judge is mandated to investigate complaints relating to alleged improper conduct by personnel appointed to support the IDAC. This oversight extends to:
- Prosecutors;
- Investigators;
- Deputy directors; and
- Seconded officials and other support staff.
Scope of Mandate and Jurisdiction
The office’s mandate covers serious, high-profile, or complex corruption, commercial crime, or financial crime arising from:
- Commissions of inquiry;
- Referrals by the National Director of Public Prosecutions (NDPP);
- Statutory referrals; and
- Complaints lodged by members of the public.
The IDAC Oversight Judge operates with strict judicial detachment and will not investigate intelligence matters falling under the Inspector-General of Intelligence, nor does it replace the investigative powers of the South African Police Service (SAPS) or the Directorate for Priority Crime Investigation (DPCI).
To safeguard its independence, the office reports to the Minister of Justice and Constitutional Development and is ultimately accountable to Parliament through the Portfolio Committee on Justice and Constitutional Development. Confidentiality for whistleblowers and complainants will be strictly maintained in accordance with the Protected Disclosures Act, No. 26 of 2000.
Complaints can be submitted electronically to [email protected]. Physical complaints will soon be accepted via a secure drop-box at the SALU Building, 316 Thabo Sehume Street, Pretoria.
