IDAC Oversight Judge Office Commences Operations

Brought to you by SAnews: In terms of the National Prosecuting Authority Amendment Act, No. 14 of 2024, the newly established Office of the Independent Directorate Against Corruption (IDAC) Oversight Judge has officially commenced its operational mandate.

The office was established to permanently integrate the IDAC within the National Prosecuting Authority (NPA) and to introduce an independent oversight mechanism to handle complaints regarding the directorate’s investigations. Oversight Judge Takalani Joseph Raulinga confirmed that while the office is fully operational, it will strictly adhere to its statutory boundaries and will not issue parallel commentary or pre-judge matters currently before active commissions of inquiry or the courts.

The statutory mandate of the IDAC Oversight Judge includes:

  • Investigating complaints of improper influence, interference, or administrative malfeasance within the IDAC;
  • Ensuring the institutional independence of the directorate’s anti-corruption investigators and prosecutors; and
  • Conducting objective, independent investigations into complaints that fall strictly within the office’s legislative purview.

Stakeholder Engagement and Reporting

In terms of its operational rollout, the Office of the Oversight Judge will initiate a structured stakeholder engagement programme over the coming months. This initiative aims to formalise working relationships with key law enforcement agencies, public institutions, and accountability bodies. The office will also issue public reports on its findings, subject to the confidentiality and security requirements prescribed by the National Prosecuting Authority Act, No. 32 of 1998.
