SACAP and NPA Partner to Enforce Architectural Profession Act
Brought to you by SAnews: The South African Council for the Architectural Profession (SACAP) has formalised a collaborative engagement with the National Prosecuting Authority (NPA) to enhance the enforcement of statutory compliance and prosecute contraventions of the Architectural Profession Act, No. 44 of 2000.
In terms of the Architectural Profession Act, No. 44 of 2000, SACAP is the statutory body mandated to regulate architectural professionals in South Africa. On 23 June 2026, representatives from SACAP met with NPA officials at the Phalaborwa Magistrate’s Court in Limpopo to establish streamlined mechanisms for investigating and prosecuting statutory offences under the Act.
The joint initiative specifically targets key compliance failures and criminal offences within the built environment sector, focusing on:
- The unauthorised use of protected professional titles by unregistered individuals;
- The practice of architecture by persons not registered with SACAP; and
- Other contraventions of the statutory provisions of Act 44 of 2000.
Under the Act, registration with SACAP is a mandatory prerequisite for any individual practicing architecture in South Africa. This requirement spans all professional categories, including:
- Professional Architects;
- Senior Architectural Technologists;
- Architectural Technologists;
- Professional Draughtspersons; and
- Candidates and specified categories.
What this means for you, your business, or your clients
- For yourself: Ensure your individual professional registration with SACAP is active and up to date, as practicing or using protected titles without valid registration carries an increased risk of criminal prosecution.
- For your business: Implement strict verification protocols to audit the registration status of all internal architectural staff and external sub-contractors to mitigate liability under Act 44 of 2000.
- For your clients: Advise clients in the property development and construction sectors to verify the SACAP registration of their architectural service providers before project commencement to avoid regulatory delays or contract invalidation.
