| (1) | The Regulator may, despite the imposition of a penalty in accordance with regulation 4(1), publish a contravention notice in the Gazette or in the manner to be determined by the Regulator. |
| (2) | In the event the Regulator publishes a contravention notice, the Regulator must be guided by factors contained in regulation 4(2). |
