A person may not be appointed or remain a member of the Board if such a person—
| (a) |
is not a citizen of South Africa; |
| (b) |
is an unrehabilitated insolvent; |
| (c) |
has been declared by a court to be mentally ill; |
| (d) |
has been convicted of an offence, whether in the Republic or elsewhere, committed after the Constitution of the Republic of South Africa, 1993 (Act No. 200 of 1993), took effect, and sentenced to imprisonment without the option of a fine; |
| (i) |
whether in the Republic or elsewhere, of theft, fraud, forgery, perjury or any other offence involving dishonesty; or |
| (ii) |
has been convicted of an offence under this Act; |
| (f) |
has any financial interest in the business of any port; |
| (g) |
is otherwise disqualified from serving as director in terms of the Companies Act. |
