| (1) | Any port user or licensed operator whose rights are adversely affected by a decision of the Authority may appeal against that decision to the Regulator in the manner directed under section 30(3). |
| (2) | After considering the appeal the Regulator must— |
| (a) | confirm, set aside or vary the decision; or |
| (b) | substitute the decision of the Authority for its own. |
