The Minister of Electricity and Energy ("the Minister"), after consultation with the National Energy Regulator of South Africa ("NERSA") and the Minister of Finance, for the purposes of ensuring security of energy supply in the national interest, acting under Section 34(1)(a) of the Electricity Regulation Act, 2006 (Act No. 4 of 2006), as amended, ("the ERA"), has determined as follows:
| 1. | A total of 10 MW of new generation capacity from: |
| • | 10 MW of own built Solar PV with a 10 MW Battery Energy Storage System. |
| 2. | The generation capacities will be built and procured by Hessequa Local municipality to contribute towards energy security. |
| 3. | The electricity procured shall target connection to the Grid as soon as possible. |
| 4. | the generation capacity must be procured by Hessequa municipality through a tendering process which is fair, equitable, transparent, competitive, and cost effective. |
