(1) |
Section 185A of the Criminal Procedure Act, 1977 (Act No. 51 of 1977), is hereby repealed. |
(2) |
Notwithstanding the repeal of section 185A of the Criminal Procedure Act, 1977— |
(a) |
any person who is detained in or who has been placed under protective custody under the said section immediately before the commencement of this Act, shall remain in such detention or placement and shall be deemed to have been placed under protection in terms of this Act; |
(b) |
any written agreement entered into between the person referred to in paragraph (a) and the Department prior to the commencement of this Act, shall, except in so far as it is inconsistent with this Act, remain valid until that person and the Director have entered into a protection agreement in terms of this Act; and |
(i) |
any regulation made under the said section and in force immediately prior to the commencement of this Act; and |
(ii) |
rule, notice, order, instruction, prohibition, authorisation, permission, consent, exemption, certificate or document promulgated, issued, given or granted and any other steps taken in terms of any such regulation prior to the commencement of this Act, |
shall remain in force, except in so far as it is inconsistent with this Act, until replaced by or in terms of a regulation made under section 23 .
