Regulations on Limited Payout Machines

Chapter 1

24. Public hearings

 

 

1) Before deciding whether to grant a-
a) Route operator licence; or
b) Site operator licence in relation to a site contemplated in regulation 3(2),

a provincial licensing authority must hold a public hearing.

 

2) If, after compliance with regulations 20 and 21, and such other procedural requirements as may be contained in the provincial legislation for the advertisement and making available of applications to the public, a provincial licensing authority receives, within a period specified in provincial legislation, a written objection to an application for a site operator licence in relation to a site contemplated in regulation 3(1), relating to-
a) the probity or suitability for licensing of any of the persons involved in the operation of the business to which the licence applied for relates; or
b) the suitability of the proposed site for the conduct of gambling activities to which the application relates,

the provincial licensing authority shall schedule a public hearing for the purpose of adjudicating the application with regards to such objection.

 

3) A provincial licensing authority must advertise the place, date and times of a public hearing in the provincial gazette and a newspaper circulating in the area in which the licensed operations are proposed to be conducted.
