| (1) |
The Commission must appoint a commissioner to attempt to resolve through conciliation— |
| (b) |
any other dispute that has been referred to it in terms of this Act. |
| (2) |
If a dispute remains unresolved after conciliation, the Commission must arbitrate the dispute if— |
| (a) |
this Act requires the dispute to be arbitrated and any party to the dispute has requested that the dispute be resolved through arbitration; or |
| (b) |
all the parties to the dispute in respect of which the Labour Court has jurisdiction consent in writing to arbitration under the auspices of the Commission. |
