| 1) | Eskom is, with effect from a date determined by the Minister by notice in the Gazette, deemed to be a public company incorporated in terms of the Companies Act and is to be known as Eskom Holdings Limited from such date. |
| 2) | The provisions of sections 32, 44(1), 54(2), 59, 63(2), 64, 172 and 344(b) of the Companies Act do not apply to Eskom. |
