| (1) |
The Minister may, by notice in the Gazette, delegate or assign any power, duty or function conferred upon him or her by or in terms of this Act, excluding the power to make regulations, to— |
| (c) |
a provincial government; |
| (d) |
a local government; or |
| (2) |
The Minister may exercise any power or perform any duty or function despite subsection (1). |
| (3) |
The Director-General may delegate or assign any of his or her powers, duties or functions— |
| (b) |
with the concurrence of the MEC, to a provincial authority; or |
| (c) |
to a statutory body that is primarily involved in cultural matters or nature conservation, |
but such delegation may not affect the obligations of the Department under the Convention.
