| (1) | The chairperson of the Tribunal must automatically suspend the act, direction or decision of the relevant entity appealed against if the appeal was lodged within 30 days of such act, direction or decision. |
| (2) | The ruling by the chairperson must be communicated to all the parties to the appeal within 7 days. |
| (3) | Any party may oppose the automatic suspension ruling of the chairperson by giving notice to the Tribunal and all other parties to the appeal within 7 days of receipt of notice of such ruling by the chairperson, which notice must set out fully the reasons for the opposition. |
| (4) | The period within which a notice of opposition of the automatic suspension or reply thereof may not be extended except on good cause shown. |
| (5) | The notice to oppose in sub-regulation (3) above, will have the effect of setting aside the ruling of the chairperson to automatically suspend the appealed act, direction or decision until a final ruling on suspension by the chairperson is made. |
| (6) | The appellant may respond to the notice to oppose the automatic suspension within 7 days of service of the notice to oppose. |
| (7) | The matter must then serve before the chairperson of the Tribunal for a final ruling on the automatic suspension. |
