| (1) | The appellant may at a hearing of an appeal rely only on the grounds and issues raised in the notice of appeal and may give only such evidence as was given before the relevant entity. |
| (2) | The appellant who did not participate in the application proceedings before the relevant entity, may at the hearing of the appeal rely on the grounds stated in his or her notice of appeal and may only give relevant evidence not given before the entity that considered the application. |
| (3) | Any party not cited or joined in the appeal proceedings and has an interest in the outcome of the appeal, may apply to be joined in the appeal proceedings and the decision to allow such participation will be at the discretion of the Tribunal. |
