| (1) | A notice of appeal must be lodged with the Tribunal within 30 days from the date of the written notice whereby the act, direction and decision of the relevant entity was received by the Appellant; or |
| (2) | In the event the appellant has not received such written notice, within 30 days of the date when the appellant first became aware of the act, direction and decision, but not later than 180 days from the date on which the act, direction, decision was taken by the relevant entity. |
| (3) | An appellant who fails to lodge an appeal within the period contemplated in subregulation (1) and (2) may apply to the Tribunal for condonation of the late filing of the notice of appeal in terms of section 13(a) of the Act, provided that: |
| (a) | the application for condonation is in writing and is lodged simultaneously with a duly completed notice of appeal with supporting documents; |
| (b) | the application for condonation is accompanied by a supporting affidavit setting out the reasons for the late filing of the notice of appeal, with supporting documents, if any, and |
| (c) | the notice of appeal and application for condonation, are received by the Tribunal not later than 180 days as contemplated in sub-regulation (1) and (2). |
| (4) | The Tribunal must consider an application for condonation prior to the hearing of the appeal. |
| (5) | A ruling by the Tribunal to condone an appellant's late filing of a notice of appeal allows the appeal to proceed as a properly filed appeal. |
