16. Decisions of Tribunal

 

(1) The Tribunal should within 21 days of the hearing of the appeal, or such extended period as may be determined by the Tribunal, finalise the decision of the hearing but not later than 30 days after the hearing of the said appeal.

 

(2) The Tribunal must within 10 days from the date it has finalised its decision, notify the relevant entity and the parties to the appeal about the decision of the Tribunal.

 

(3) A decision of the Tribunal must be delivered in writing to the parties to the appeal and must include full particulars of the Tribunal’s decision with reasons and set out whether the appeal fee or any part thereof is to be refunded to or forfeited by the appellant.

 

(4) In the event that the entity concerned has failed to comply with the decision of the Tribunal, the Tribunal must within 10 days of such failure, issue a directive in accordance with Form TAT-04 to the relevant entity in terms of Section 12 (5).

 

(5) The Tribunal must immediately thereafter notify the Director General of the Directive issued to the entity and attach a copy thereof in terms of Section 12(6) of the Act, on Form TAT - 05.
