A person may not be appointed as a member of the Council if he or she—
| (a) |
is not a South African citizen; |
| (b) |
has been convicted of an offence in respect of which he or she was sentenced to imprisonment without the option of a fine; |
| (d) |
has been diagnosed as having a mental illness or is a mental health care user as defined in section 1 of the Mental Health Care Act, 2002 (Act No. 17 of 2002); |
| (e) |
is an unrehabilitated insolvent or has entered into a composition with his or her creditors; |
| (g) |
is, at the time of his or her appointment, or was, during the preceding 12 months— |
| (i) |
a member of the National Assembly, any provincial legislative body, National Council of Provinces or any municipal council; or |
| (ii) |
an office bearer or employee of any party, organisation or body of a political nature. |
