Regulations on the South African Citizenship Act, 1995

5. Citizenship by marriage

 

(1) The period of ordinary residence referred to in section 5(5)(b) of the Act is 10 years immediately preceding the date of application for naturalisation.

 

(2) A spouse or surviving spouse referred to in section 5(5) of the Act must, at the time of his or her application for naturalisation, not have been absent from the Republic for a period of more than 90 days in any year during the five-year period of ordinary residence immediately preceding the date of application for naturalisation.

 

(3) A spouse or surviving spouse who has been absent from the Republic for a period of more than 90 days in any year during the five-year period of ordinary residence immediately preceding the date of application for naturalisation does not qualify for naturalisation.
