13. Appeal against Registrar’s decision

 

(1) On appeal the court shall hear the parties and the Registrar, if he desires to be heard, and shall make an order determining whether and subject to what conditions, if any, registration is to be permitted.

 

(2) On the hearing of an appeal under this section any party may, by special leave of the court, bring forward further evidence for the consideration of the court.

 

(3)

(a) On an appeal under this section no further grounds of objection to the registration of the copyright in a cinematograph film shall be allowed to be taken by the objector or the Registrar, other than those so stated as aforesaid by the objector, nor shall the applicant be entitled to raise any further ground in support of his application, except by special leave of the court.
(b) If any party, by special leave of the court, introduces any further grounds and the other party decides in the light thereof not to pursue the proceedings, the court may make such order as to costs as it may deem fit.

 

(4) The court may require the appellant to give security for the costs of the proceedings relative to the appeal and in default of such security being given, the court may treat the appeal as abandoned.
