Chapter 5 : Provisions regarding Improper Conduct, the Enforcement of the Code and Other Matters relating thereto, and General Powers

26. Improper conduct by an employer of in-house security officers

 

(1) An employer of in-house security officers who—
(a) contravenes or fails to comply with a provision of the Act;
(b) contravenes or fails to comply with a provision of the Levies Act; or
(c) contravenes or fails to comply with a provision of this Code,

is guilty of improper conduct and on conviction liable to any penalty contemplated in regulation 27.

 

(2) Any conspiracy, incitement or attempt to commit any act contemplated in subregulation (1)(a), (b) or constitutes improper conduct as contemplated in subregulation (1).

 

(3) Every contravention or failure to comply as contemplated in subregulation (1), or (2) constitutes a separate count of improper conduct in respect of which any penalty contemplated in regulation 27 may be imposed.
