| (1) |
The International Trade Administration Commission is hereby established, and— |
| (a) |
has jurisdiction throughout the Republic; |
| (b) |
is a juristic person; and |
| (c) |
must exercise its functions in accordance with this Act and any other relevant law. |
| (a) |
is independent and subject only to— |
| (i) |
the Constitution and the law; |
| (ii) |
any Trade Policy Statement or Directive issued by the Minister in terms of section 5; and |
| (b) |
must be impartial and must perform its functions without fear, favour or prejudice. |
| (3) |
Each organ of state must assist the Commission to maintain its independence and impartiality, and to exercise its authority and carry out its functions effectively. |
